MIBA VIP Terms and Conditions of Sale

These MIBA VIP Terms & Conditions are between you and Mums In Business Association and their affiliates ("MIBA","Mums In Business Association",“we”, "us" or “our”) and they govern your and our respective rights and obligations. 

Together with the below linked terms and notices (collectively, these "Terms"), they constitute the agreement between you and us related to your MIBA VIP membership on the miba.thinkific.com website. Please read these Terms carefully.

1. The Service 

MIBA VIP is a membership program offering course content to its members as set out in these Terms.

Stripe Card Processing and Thinkific collects the MIBA VIP membership fee and is the seller of record of delivery and digital benefits.

2. VIP Benefits 

2.1. VIP Benefits

VIP members can benefit from a range of course each month.

VIP is updated on the 1st of each month with additional content either downloadable or viewable with subscription.

3. Membership

3.1. Membership fees, models and duration

MIBA VIP is hosted on the Thinkific Learning platform, all subscriptions, accounts, courses are managed and accessed on Thinkific.

If you sign up for your VIP membership using a discount code only the first month will be at the discounted rate.

The MIBA VIP membership fee is non-refundable except as expressly set forth in these Terms.

3.2. Payment

If you sign up for your MIBA VIP membership through us, are billed by us and you do not cancel through the members area before the next due date of your membership fee we will automatically charge the then-applicable periodic membership fee using your preferred payment method. 

If your preferred payment method becomes invalid during your membership period, or if the charge is refused for any other reason outside our control, you authorize us to use any other payment method we have on file in your customer account. If all your payment methods on file are declined, you must provide us a new eligible payment method within 4 days or your membership will be canceled.

Payment is via Stripe card processing, no credit card details are held by Mums In Business Association or Thinkific.

3.3. Cancellation by you and refunds

If you signed up for your MIBA VIP through us or affiliates, you may cancel it any time by visiting the billing area and adjusting your membership settings. Cancellation will take place at the end of your current billing period.

No refunds will be given for any incorrect purchases or none use of VIP after sign up.

3.4 Billing Period 

The billing period is the monthly date of your initial sign up.  eg Sign up on the 5th, your billing date will be monthly on the 5th.

3.5 Promotions and trial memberships 

From time to time, we may offer certain customers specific trial or other promotional memberships (usually 1 month via discount code), when the promotion has finished the default current membership price will be applied and recur monthly until you cancel the subscription. 

If for any reason there is a failure to enter the discount code at checkout a refund will not be processed.  The customer should confirm the details of the order prior to checking out, the discount will be shown on screen at checkout if applied correctly.

3.6. Acceptance of membership

We reserve the right to accept or refuse your membership, to the extent permitted by applicable law.

3.7. No transfer or assignment of membership or benefits

You may not transfer or assign your MIBA VIP membership including promotion codes, except as expressly allowed in these Terms.

3.8. No resale, copy or redistribution to customers

VIP members are not permitted to export and share content to non members.

3.9. No minors

The MIBA VIP is only available to end consumers aged 18 years or older.

4. Termination 

We may terminate your MIBA VIP and issue a refund depending on the reasons provided. Outside of the 2 month window as mentioned in point 3.2 no refunds for any period will be refunded.

We may terminate your MIBA VIP membership immediately by notice if we consider that (a) your use of the MIBA VIP materially breaches these Terms  or (b) you fraudulently use or misuse the MIBA VIP content. In this case we will not give any refund. We will inform you of the termination of your MIBA VIP membership and your right to appeal.

You may terminate your MIBA VIP membership at any time in accordance with Clause 3.3.

5. Agreement Changes

We may change these Terms or the MIBA VIP membership, or any part of it, at any time: for legal reasons; for security reasons; to enhance existing features or add additional features to the membership.

If we make changes, we will inform you in due form and time about it and remind you of your rights. 

Regardless of any changes to these Terms, any increase in the applicable membership fee will not apply before the end of your current membership period. 

If any change is found invalid or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions

6. Our Liability

We are liable for any damage you suffer as a result of gross negligence or wilful misconduct by us, including by our directors and legal representatives.

In addition, we are liable for breach of our obligations under these Terms which are essential for the provision of MIBA VIP and which you rely on when joining the membership. In this case, we are only liable for losses and damage that were foreseeable to both you and us when you joined.

Nothing in this paragraph affects your statutory rights as a consumer.

7. Events Beyond our Reasonable Control

We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is non foreseeable and beyond our reasonable control.

Standard Courses Terms and Conditions of Sale

These MIBA Standard Courses Terms & Conditions are between you and Mums In Business Association and their affiliates ("MIBA","Mums In Business Association",“we”, "us" or “our”) and they govern your and our respective rights and obligations. 

Together with the below linked terms and notices (collectively, these "Terms"), they constitute the agreement between you and us related to the standard courses on the miba.thinkific.com website. Please read these Terms carefully.

1. The Service 

Standard courses are purchased as a one time purchase thus making the contents yours to view as many times as you want with no expiry.  They are sold in accordance with the terms below.

2. Payment

2.1. Method of Payment

Stripe Card Processing and Paypal can be using to purchase these courses.

2.2. Cancellation by you and refunds

Refunds are not given for one time payment courses.

2.3. Promotions and trial memberships 

From time to time, we may offer certain customers specific trial or other promotional prices.
